BEFORE YOU ORDER
Terms & Conditions
We keep the legal stuff straightforward. By requesting or purchasing a print from U3K Printworks, you agree to the applicable terms below. Please review them before placing an order.
VIEW TERMS & CONDITIONS01About U3K Printworks
U3K Printworks (“U3K”, “we”, “us”, or “our”) is an Alberta sole proprietorship providing custom 3D-printing and related services from Edmonton, Alberta.
These Terms apply to quote requests, orders and services supplied by U3K unless otherwise agreed in writing.
02Customer-Submitted Models and Intellectual Property
The customer is solely responsible for ensuring that every file, model, image, design, link, specification or other material submitted to U3K may lawfully be reproduced for the requested purpose.
By submitting a model or instructing U3K to reproduce a model, the customer represents and warrants that:
- the customer owns the model or has obtained all permissions, licences and other rights necessary to have it reproduced by U3K;
- the requested reproduction does not infringe any copyright, trademark, patent, industrial design, contractual licence restriction or other proprietary right of a third party;
- any conditions attached to the model's licence, including attribution, commercial-use or reproduction restrictions, have been satisfied; and
- the customer's instructions and intended use are lawful.
U3K provides a printing service and does not undertake to research, investigate, interpret or independently verify the licence or intellectual-property status of customer-submitted models.
U3K's acceptance of a file, link or order does not constitute confirmation that the customer has the legal right to reproduce it.
U3K may request evidence of authorization or decline any project where ownership, licensing, legality or permitted use appears unclear.
03Customer Indemnity
To the maximum extent permitted by applicable law, the customer agrees to indemnify and hold harmless U3K Printworks, its proprietor, representatives and contractors from claims, demands, proceedings, losses, damages, liabilities and reasonable costs arising from or relating to:
- a model, file, link, design or instruction supplied by the customer;
- an allegation that the requested reproduction infringes a third party's intellectual-property or contractual rights;
- the customer's breach of the representations or obligations contained in these Terms; or
- the customer's unlawful or unauthorized use of a printed item.
This indemnity does not apply to liability that cannot lawfully be excluded or transferred under applicable law.
04Right to Refuse or Cancel a Print
U3K may decline, pause or cancel a project that U3K reasonably believes:
- may violate applicable law;
- may infringe third-party rights;
- poses an unreasonable safety risk;
- cannot be reliably produced using available equipment or materials;
- contains prohibited or dangerous subject matter; or
- otherwise falls outside the capabilities or services offered by U3K.
Where U3K cancels an accepted order before meaningful production has begun, amounts paid for the unperformed portion of the order will be refunded unless otherwise permitted by law.
05Quotes and Pricing
Prices shown on the website are starting prices and are not binding quotations.
Final pricing may take into account material consumption, supports, purge waste, machine time, model complexity, print orientation, quantity, required quality, specialty materials, post-processing, delivery and other production requirements.
A quotation becomes binding only when U3K confirms the final price and the customer accepts the quotation.
Applicable taxes and delivery charges, if any, will be disclosed before payment.
06Payment and Order Acceptance
Submission of a quote request does not create an obligation to purchase and does not require U3K to accept the project.
An order is accepted when the customer approves U3K's quotation and completes any required payment or deposit.
By approving a quotation or submitting payment, the customer confirms acceptance of these Terms.
U3K may require full payment before production begins.
07Turnaround Times
U3K aims to complete many standard orders by the next business day; however, all turnaround times are estimates unless U3K expressly agrees otherwise in writing.
Production time may be affected by model complexity, print duration, printer availability, material availability, order volume, failed prints, maintenance, power interruptions and other circumstances outside U3K's reasonable control.
U3K will not knowingly promise a completion date that it does not reasonably expect to meet.
08Nature of 3D-Printed Parts
Customers acknowledge that fused-filament 3D printing is an additive manufacturing process and that reasonable cosmetic and dimensional variations may occur.
Printed parts may exhibit layer lines, seams, minor surface marks, support-contact marks, colour variation or dimensional tolerances inherent to the printing process.
Unless expressly agreed otherwise, U3K does not warrant that a customer-supplied design is fit for a particular engineering, structural, mechanical, safety-critical, medical, electrical, automotive, food-contact or other specialized application.
The customer is responsible for determining whether the design and selected material are suitable for the customer's intended use.
09Customer-Supplied Designs
U3K generally prints customer-supplied designs as provided.
U3K is not responsible for defects in the underlying model, including incorrect dimensions, inadequate tolerances, insufficient wall thickness, poor geometry, design defects or incompatibility with other components.
Where U3K identifies an obvious printing concern, U3K may suggest changes, but doing so does not make U3K the designer or engineer of the customer's model unless separate design services have expressly been purchased.
Multi-piece prints, fitment and assembly
Multi-piece orders are supplied as separate, unassembled parts. U3K does not provide assembly. The customer is responsible for assembly, checking fitment and compatibility, and any sanding, trimming, fastening, adhesive application or other adjustments needed to assemble the parts.
Unless expressly agreed in writing, U3K does not guarantee that customer-supplied parts will fit together or fit other components. To the maximum extent permitted by applicable law, U3K is not responsible for fitment problems arising from the supplied design, customer dimensions, inadequate tolerances, normal printing variations within the agreed specifications, or the customer’s assembly or modifications.
This provision does not exclude responsibility for a material U3K production error or an item materially different from the approved order. Section 10 and all consumer rights and remedies that cannot lawfully be excluded continue to apply.
10Reprints, Defects and Remedies
If U3K makes a material production error or supplies an item materially different from the approved order, the customer should contact U3K promptly.
Where reasonably appropriate, U3K may repair, reprint, replace or refund the affected item.
U3K is not responsible for problems caused by incorrect customer dimensions, defective customer files, unsuitable designs, misuse, modification, exposure beyond the material's reasonable capabilities or normal wear.
Nothing in this section limits any remedy the customer is entitled to under applicable consumer-protection legislation.
11Cancellations and Custom Products
Because orders are custom-manufactured, cancellation may not be possible after printing has begun or material has been specifically committed to the job.
Where production has not begun, U3K will make reasonable efforts to accommodate a cancellation request.
Any cancellation or refund policy remains subject to rights and remedies that cannot legally be excluded under Alberta consumer-protection law.
12Pickup and Delivery
Free pickup may be offered from a designated South Edmonton pickup location.
Exact pickup instructions may be supplied after an order is confirmed.
Customers are responsible for collecting completed orders within a reasonable period after notification.
Local delivery may be available for an additional charge and is subject to location and availability.
Risk associated with third-party shipping or delivery services will be handled in accordance with applicable law and the terms disclosed for that order.
13Limitation of Liability
To the maximum extent permitted by applicable law, U3K will not be liable for indirect, incidental, special or consequential losses arising from the use, misuse, failure or unsuitability of a customer-requested printed item.
Where liability may lawfully be limited, U3K's aggregate liability relating to a particular order will not exceed the amount paid to U3K for that order.
This limitation does not exclude liability or statutory rights that cannot legally be excluded or limited.
14Prohibited Uses
U3K will not knowingly manufacture items whose production or intended use would violate applicable law.
Customers must not submit models or request prints for unlawful purposes.
U3K reserves the right to decline any project in its reasonable discretion.
15Privacy and Submitted Information
U3K collects only the personal information reasonably required to quote, produce, deliver and support customer orders and to operate the business.
Customer information and uploaded files may be processed or stored using third-party service providers used by U3K for website hosting, forms, email, invoicing, payment processing or business administration.
U3K will use reasonable safeguards to protect personal information and will retain information only as reasonably necessary for business, legal and operational purposes.
Questions concerning personal information may be directed to hello@u3k.ca.
16Third-Party Websites and Model Repositories
References or links to MakerWorld, Printables, Cults3D, Thangs or any other third-party platform do not imply that U3K owns, endorses or controls models hosted on those services.
Licensing conditions are determined by the model creator and/or applicable platform and may vary from model to model.
Customers are responsible for reviewing and complying with those conditions before requesting reproduction.
17Alberta Consumer Rights
Nothing in these Terms waives, limits or excludes any right, protection or remedy that cannot lawfully be waived, limited or excluded under the Alberta Consumer Protection Act or other applicable law.
If any provision of these Terms conflicts with a mandatory statutory right, the statutory right will prevail to the extent of the conflict.
18Governing Law
These Terms are governed by the laws of Alberta and the applicable federal laws of Canada.
Any dispute will be dealt with in accordance with applicable law, including any mandatory rights available to Alberta consumers.
19Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
20Changes to These Terms
U3K may update these Terms from time to time.
The Terms applicable to an order are the version made available to the customer when the order is accepted.
